Leave management in the Philippines: statutory leaves and how to administer them

Service incentive, maternity, paternity, solo parent, VAWC and special leave for women in the Philippines, plus how to manage leave balances and approvals.

Philippine law grants several statutory leaves, including service incentive leave (5 days a year after one year of service), maternity leave (105 days), paternity leave (7 days), solo parent leave (7 working days), leave for victims of violence against women and their children (up to 10 days) and special leave for women after gynecological surgery (up to two months). Most companies also grant vacation and sick leave by policy. Managing all of them consistently across branches requires clear rules, accurate balances and approvals that payroll can trust.

Statutory leave summary

LeaveLegal basisEntitlement (summary)

Special leave for womenRA 9710Up to two months with full pay after surgery caused by gynecological disorders, subject to service requirements

Under RA 11210, the mother may also allocate up to 7 days of her maternity leave to the child's father or an alternate caregiver. Each law has conditions and documentary requirements; check the implementing rules and the relevant agency guidance.

How maternity leave is paid

SSS pays the maternity benefit to qualified members through the employer, and the employer generally pays the salary differential between the benefit and the employee's full pay, unless the employer falls under an exemption in the law's rules. Payroll needs to handle the advance, the SSS reimbursement and the differential correctly. Plan this with your payroll team for every expected maternity leave.

Company leave policies

Beyond statutory leave, most medium and large employers grant vacation leave and sick leave, sometimes combined as paid time off. Your policy should define:

  • Accrual (monthly, annually or upfront) and eligibility dates
  • Carry-over limits and expiry
  • Conversion to cash at year-end or separation (and the tax treatment of monetized leave, which has a de minimis ceiling for private employees; see de minimis benefits)
  • Notice and documentation requirements, such as medical certificates
  • Approval stages by role and branch

Common leave administration problems

  • Balances kept in spreadsheets that do not match payroll
  • Leave approved by chat with no record, then disputed later
  • SIL not converted for employees who did not use it
  • Maternity differential computed manually and inconsistently
  • Different branches applying the same policy differently

What a leave management system should do

  1. Track balances per leave type with accrual rules and history.
  2. Let employees file requests from a phone with attachments.
  3. Route approvals through the right stages, with reminders before cutoff.
  4. Show team calendars so managers can plan coverage.
  5. Send approved leave to payroll as paid or unpaid days automatically.
  6. Report leave usage, balances and liabilities by company and branch.

Cirquolus Timekeeping handles employee requests with approval stages and request history, and the employee portal lets employees file leave, overtime and scheduling requests and view their attendance. Approved leave flows into payroll. See also employee self-service portals.
