BIR Form 2316: what employers must issue, when and how to get it right
What BIR Form 2316 is, who receives it, deadlines for issuance and submission, substituted filing, mid-year hires and how to avoid common errors.
BIR Form 2316, the *Certificate of Compensation Payment / Tax Withheld*, shows an employee's total compensation for the year, the non-taxable and taxable portions, and the income tax withheld. Employers must give it to each employee on or before January 31 of the following year, or on the day of last payment of wages if the employee separates during the year. Employers also submit copies to the BIR within the deadline it prescribes.
For employees who qualify for substituted filing, the 2316 replaces their own annual income tax return.
What Form 2316 contains
- Employee and employer details, including TINs
- Period of employment with the employer
- Gross compensation, broken down into non-taxable items (such as statutory minimum wage, mandatory contributions, de minimis benefits and 13th month pay and other benefits up to ₱90,000) and taxable items
- Total tax due for the year and total tax withheld, including amounts from a previous employer when applicable
- Signatures of the employer's authorized representative and the employee
The figures come directly from your year-end annualization, so the quality of the 2316 depends on the quality of the payroll year behind it.

Check current BIR issuances each year, as submission formats and channels change.
Substituted filing
An employee qualifies for substituted filing, meaning the 2316 serves as their annual return, when generally:
- They received purely compensation income during the year
- From only one employer in the Philippines for the year
- The tax due equals the tax withheld by that employer
- The employer files the 1604-C with the alphalist and submits the 2316 copies
Employees with two or more employers in the year, concurrently or successively, or with business or professional income, generally need to file their own BIR Form 1700 or 1701. HR should tell affected employees.
New hires with a previous employer
When you hire someone mid-year, ask for the 2316 from the previous employer during onboarding. You need it to include their earlier compensation and tax withheld in your annualization. Without it, the employee may be under-withheld and face a tax bill when filing. Make it a standard item in your onboarding checklist.
Common Form 2316 errors
- Missing previous employer data for mid-year hires
- Wrong classification of benefits between taxable and non-taxable
- 13th month pay and other benefits not capped correctly at ₱90,000
- Late issuance to separated employees, which delays their next employer's payroll
- Mismatches between the 2316, the alphalist and the monthly 1601-C remittances
- Unsigned forms or missing TINs
A simple control: reconcile total taxable compensation and total tax withheld across all 2316s with the twelve 1601-C returns before you file.
Producing 2316 from payroll software
Your payroll system should generate Form 2316 data from the same records used for annualization and the alphalist, so the three always agree. Cirquolus Payroll includes withholding tax workflows, 13th month pay and annualization in one approval process, and employees can access payroll documents through the employee portal.
